1. Agreement to these terms

These Terms of Service (“Terms”) are a binding agreement between you and [Legal Entity Name] (“we,” “us,” or “our”) regarding your use of VacayForge websites, apps, and related services (the “Service”).

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

VacayForge lets people discover, create, and share day-by-day vacation itineraries with maps, media, and social features.

VacayForge is not a travel agency, tour operator, airline, hotel, insurer, or booking agent. We do not sell travel inventory ourselves. Any bookings you make happen on third-party sites under their terms.

3. Accounts

  • You must be old enough to form a binding contract in your jurisdiction (and at least 13).
  • You may sign in using supported third-party providers (for example Google or X).
  • You are responsible for activity on your account and for keeping access secure.
  • Provide accurate information and keep your profile reasonably up to date.
  • We may refuse, suspend, or terminate accounts that violate these Terms.

4. User content

You retain ownership of content you create (trips, photos, comments, reviews, and similar materials) (“User Content”).

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, publish, display, and distribute that content as needed to operate, promote, and improve the Service—consistent with the visibility settings you choose.

You represent that you have the rights to the User Content you post and that it does not violate law or others’ rights. Published public content may be viewed by anyone, including search engines and guests who are not signed in.

5. Acceptable use

You agree not to:

  • Post illegal, harmful, fraudulent, hateful, or harassing content
  • Infringe intellectual property, privacy, or publicity rights
  • Impersonate others or misrepresent your affiliation
  • Spam, scrape, or overload the Service in abusive ways
  • Attempt to bypass security, access others’ private data, or disrupt the Service
  • Use the Service to distribute malware or engage in unlawful activity

We may remove content or restrict access when we reasonably believe these rules have been violated.

6. Maps and third-party place data

Maps, place search, and location details may come from third parties (including Google Maps / Places). That information can be incomplete or inaccurate. Use of map features may also be subject to the third party’s terms and privacy policy.

7. Booking and affiliate links

The Service may show optional “Book” or similar links to hotels, flights, activities, or other travel products. Those links may be affiliate links: we may earn a commission if you click and complete a transaction with a partner.

  • Partners set prices, availability, cancellation policies, and customer support.
  • Your contract for any booking is with the partner, not with VacayForge.
  • We are not responsible for partner inventory, errors, refunds, or travel disruptions.

8. Social features

Features such as comments, reviews, follows, friends, saves, and notifications are provided to help travelers share tips and stay connected. We may moderate or remove interactions that violate these Terms or create risk for users.

9. Our intellectual property

The Service—including branding, design, software, and trademarks—is owned by us or our licensors. Except for the limited rights needed to use the Service, no rights are granted to you. You may not copy, reverse engineer, or exploit the Service except as allowed by law or with our written permission.

10. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ITINERARIES AND TIPS ARE LARGELY USER-GENERATED AND MAY BE WRONG, OUTDATED, OR UNSUITABLE FOR YOUR PLANS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not guarantee uninterrupted or error-free operation, or that content will always be secure or available.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, [Legal Entity Name] AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR TRAVEL EXPENSES, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY ITINERARY OR THIRD-PARTY BOOKING.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the maximum extent permitted.

12. Indemnity

You agree to defend, indemnify, and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service at any time and may delete your account where that feature is available. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive (including ownership, disclaimers, limitations, and indemnity) will survive termination.

14. Governing law

These Terms are governed by the laws of [Governing Law / Jurisdiction], without regard to conflict-of-law rules, except where mandatory local consumer protections apply. Courts in that jurisdiction will have exclusive venue for disputes, subject to applicable law.

15. Changes to these Terms
